What can I do about a wrongful gun purchase denial?

There are three steps that our attorneys can help you take:

  • First, our office can file an Appeal request with the Federal Bureau of Investigation’s (FBI) Criminal Justice Information Services (CJIS) division. This forces them to review the denial of your gun purchase, based on supporting documentation that we provide, and potentially reverse their decision.

  • Second, our office can submit a Voluntary Appeal File (VAF). This gives you a UPIN number that will identify you as a lawful firearm purchaser with law enforcement, for purchases that occur down the road after the initial denial is corrected.

  • Third, if the FBI CJIS refuses to budge on the appeal or the VAF, we can also file an §925a lawsuit in federal court. This allows a federal judge to force the FBI to reverse your appeal denial and issue you a UPIN so that you don’t face gun purchase problems in the future.

What if I’m unsure about my criminal record, and the denial of my gun purchase might have been correct?

When you hire us, the first thing we do is to review your entire criminal record and confirm that you are actually authorized to purchase a firearm. If we discover an outstanding criminal record that is getting in the way, then we can pursue an expungement, a State pardon, or a Federal pardon, to ensure that your gun rights are restored. It is very rare that a person is permanently disqualified from owning a firearm.
